This agreement is executed by and between “The Guest” and the agent for the property owner, Samson Waters Vacation Rentals Inc., a company duly incorporated under the laws of Canada, jointly and severally, hereinafter referred to as “Samson Waters”.
TERMS & CONDITIONS OF RENTAL BY AND BETWEEN SAMSON WATERS AND THE GUEST:
RESERVATION DEPOSIT – a reservation deposit of 50% of the rental amount is required to confirm any reservation. The balance of the total reservation amount is due and will be charged to the Guest, 30 days prior to the arrival date. All payments made are non-refundable for any reason. Travel insurance is strongly recommended in order to prevent any issues.
NON-REFUNDABLE DAMAGE WAIVER – A non-refundable damage waiver is required for all rentals which is payable at time of booking. A damage waiver shall cover a limited amount of damages caused by The Guest. The Guest is financially and legally responsible for all damage to the property which includes the common areas of the property. Any damages exceeding the allotted amount shall be charged to The Guest’s credit card on file. The Non-Refundable Damage Waiver shall be charged as follows:
Studio & 1 bedroom properties – $35 usd and covers up to $1000 usd in damages
2 and 3 bedroom properties – $50 usd and covers up to $1500 usd in damages
4+ bedroom properties – $90 usd and covers up to $2000 usd in damages
Damages include but are not limited to:
- Exceeding the maximum allowed occupancy as stipulated in the reservation contract;
- Violating the building or homeowner association rules;
- Smoking inside the property;
- Pets on property;
- Parties or gathering of excessive amount of people;
- Noise Disturbances;
- Illegal or immoral acts;
- Maintaining hazardous, poisonous, corrosive or flammable substances.
Damages DO NOT include any illegal acts such as theft, vandalism, arson, or any other act that would be deemed contrary to local laws and regulations.
SUBSTITUTION – The Guest acknowledges and understands that should the property become unavailable for any reason during The Guest’s agreed upon occupancy, Samson Waters reserves the right to relocate The Guest to the best available and comparable property or The Guest has the right for a refund of all monies paid less credit card processing fees if an agreement cannot be reached between the Guest and Samson Waters.
REFUNDS – If Guest needs to cancel their reservation, a refund is issued according to the guidelines and limitations outlined below:
50% of the amount paid by Guest will be refunded if cancellation occurs more than 60 days prior to the arrival date.
25% of the amount paid by Guest will be refunded if cancellation occurs 31-60 days prior to the arrival date.
No Refunds if cancellation occurs less than 30 days prior to the arrival date.
No Refunds are issued for rentals occurring between December 19th and January 7th.
HURRICANE POLICY – Samson Waters does not offer refunds or reschedule trips due to hurricane activity. If you are concerned about possible interruption, cancellation or delayed travel due to tropical occurrences, you are strongly encouraged to purchase travel insurance.
LIABILITY AND INTENT – Neither Samson Waters nor the owner of the property shall be responsible for any accidents or injuries to The Guest before, during or after occupancy. Samson Waters, its owners and agents are not responsible for theft, lost or stolen items.
CONCIERGE SERVICES – Samson Waters offers The Guest Concierge Services which include but are not limited to; organizing transportation to and from the property, organizing tours & excursions, and organizing private chef services. Samson Waters uses 3rd party companies for all concierge services and therefore are not liable for any injury, death, damages, theft, delays, or cancellations while utilizing those services.
PHYSICAL DISABILITIES – Mexico does not conform to international standards (including Canadian, American, & European) regarding accommodating persons with disabilities. Please consult with a Samson Waters representative before booking your unit to ensure your needs are met. Should a unit be booked without prior consultation and is not accommodating to a particular disability, Samson Waters will try to find alternate accommodations but is ultimately not responsible for re-reimbursement of funds paid.
PROOF OF CITIZENSHIP – To enter the rental destination country, you must have a valid Passport. This applies to children, toddlers, and infants. Consult with your country’s Embassy prior to travel to ensure you will not be denied entry into your destination country. Samson Waters or the owner is not liable for any issues regarding denied entry and subsequent inability to utilize a Samson Waters unit.
RESPONSIBILITY – The Guest hereby assumes all risk of damage to any and all personal property of the property owner and The Guest, including household furniture and goods during such use and occupancy. The Guest hereby assumes any and all risks associated with the foregoing and agrees to hold the property owner and/or Samson Waters harmless from and indemnify owner and/or Samson Waters against the same. Some activities that The Guest may engage in are especially dangerous, and include motorcycle, scooter, and four-wheeler (ATV) rentals, horse-back riding, SCUBA diving, deep-sea fishing, golfing, pool and ocean swimming and surfing.
The above lists are not all-inclusive, but simply point out some of the hazards of vacationing in foreign countries. Therefore, The Guest agrees that they are voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property.
USE – It is agreed that the Premises shall be used only for residential purposes and for no other purpose whatsoever. The Guest agrees to observe and comply with all restrictions, laws and ordinances affecting the Premises or occupancy thereof. The Guest further agrees that no use shall be made of the Premises, or acts done which will increase the existing rate of insurance upon the Premises, or will cause a cancellation of any insurance policy covering the Premises.
Smoking is not permitted in any residence. A $150 fee may be charged for ionization, if smoking in the property is detected.
VENUE IN CASE OF DISPUTE – By booking a vacation with Samson Waters, The Guest acknowledges and agrees that the venue for any dispute or claim that The Guest may wish to make regarding vacation arrangements made by Samson Waters shall be made in the country of Samson Waters’ choice and will depend on the location of the property rented.
